Introduction
Get Shift, Inc. dba Shift (“Shift”, "Company" or "We") is committed to protecting the privacy of your data and the information that you share with us. We take your privacy and data ownership seriously.
This policy describes the types of information we may collect from you or your employees, or that you or your employees may provide to us when you use our Shift employee engagement platform (our "Platform") and our practices for collecting, using, maintaining, protecting, and disclosing that information.
This policy applies to information we collect:
- On our Platform, including information that you or your employees may enter.
- Through connections or links between the Platform and your third-party systems, such as your Point of Sale system (“POS”), Learning Management System (“LMS”), or other Human Resources Information Systems (“HRIS”).
- In email, text, and other electronic communications between you or your employees and this Platform.
This policy does not apply to information collected by us offline, or through any other means.
By accessing or using this Platform, you agree to its terms and conditions. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of this Platform after we make changes is deemed to be acceptance of those changes.
Information We Collect and How We Collect It
We collect several types of information from and about subscribers to our Platform and their employees, including:
- Information by which they may be personally identified, such as name, postal address, e-mail address, telephone number, or any other identifier by which you may be contacted online or offline; financial information (including credit card or other financial account information that you may use to pay for our services); and additional information about your employees and their activities in your workplace that may be displayed or used by the Platform, including their background, hobbies and interests, date of hire, performance metrics, training status and progress, and survey responses (collectively, "personal information"); and
- Information that is about you or your employees but individually does not identify you or them.
We collect this information:
- Directly from you or your employees when you or they provide it to us; and
- From your POS, LMS, and/or HRIS systems that you connect to our Platform, or that you permit our Platform to connect to.
Information You and Your Employees Provide to Us
The information we collect on or through our Platform may include information that you or your employees provide to us by filling in forms on our Platform, by responding to employee surveys published on our Platform, by using its various features and functions, and/or by uploading documents or other electronic information to us via our Platform.
Information We Collect Through Third-Party Systems
The information that we collect on or through our Platform through the POS, LMS, HRIS, or other third-party systems linked to our Platform include information about your employees’ work activities, work performance, training status, and third-party feedback concerning your employees, such as feedback about your employees that is provided by your customers.
How We Use Your and Your Employees’ Information
We use information that we collect about you and your employees, and that you and your employees provide to us:
- To provide you and your employees with access to our Platform and its features and functions.
- To provide you and your employees with information, products, or services that you request from us.
- To fulfill any other purpose for which you or your employees provide it.
- To notify you about changes to our Platform.
- In an anonymous manner, aggregated with other uses of our Platform, for our own internal research, product development, and product improvement purposes.
- For any other purpose with your express consent and upon written notice to you of such use.
Data Minimization and Quality
We are committed to collecting and processing only the personal information that is necessary for the purposes described in this policy. We implement the following data minimization and quality practices:
- Data Minimization. We limit the collection and retention of personal information to what is directly relevant and necessary for the purposes for which it is processed. Our Software Development Lifecycle (SDLC) includes schema checks to verify that no unnecessary PII fields are collected or stored within production databases.
- Data Quality. We take reasonable steps to ensure that personal information we collect is accurate, complete, and up-to-date for the purposes for which it is used. We encourage you to contact us to update or correct your personal information if it changes or if you believe any information we hold about you is inaccurate.
- Purpose Limitation. We process personal information only for the specific purposes disclosed in this policy or for compatible purposes that you would reasonably expect. We will not use your personal information for new, unrelated purposes without obtaining your consent, unless required or permitted by law.
Lawful Bases for Processing (GDPR Article 6)
If you are located in the European Economic Area (EEA), the United Kingdom, or Switzerland, we process your personal information based on the following lawful bases under the General Data Protection Regulation (GDPR):
Disclosure of Your Information
We may disclose personal information that we collect or that you provide as described in this privacy policy:
- To our subsidiaries and affiliates.
- To contractors, service providers, and other third parties we use to support our business.
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our Platform users is among the assets transferred.

- For any other purpose disclosed by us when you provide the information.
- With your consent.
We may also disclose your or your employees’ personal or other information:
- To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
- If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our employees, customers, or others.
Cookies and Tracking Technologies
Our Platform may use cookies and similar tracking technologies to enhance your experience. Cookies are small data files stored on your device that help us understand how you use our Platform.
- Essential Cookies. We use certain cookies that are strictly necessary for the operation of our Platform, such as those that enable you to log in, navigate between pages, and access secure areas. These cookies do not require your consent and cannot be disabled without affecting the functionality of the Platform.
- Non-Essential Cookies and Opt-In Consent. For all non-essential data processing activities, including advanced analytics cookies, advertising cookies, third-party marketing tools, and behavioral tracking technologies, we will obtain your prior affirmative consent (opt-in) before collecting or processing such data. You will be presented with a clear and prominent consent mechanism when you first access our Platform, and you may update your preferences at any time through your account settings or by contacting us at privacy@shiftplatform.tv.
- Opting Out Does Not Affect Platform Access. Your decision to opt out of non-essential data processing, including third-party marketing and tracking cookies, will not affect your ability to access or use the core features and functionality of our Platform. We will not condition your use of the Platform on your consent to non-essential data processing activities that are not necessary for the performance of our services.
Rights Regarding Your Personal Information
You have the right to request access to the personal information we hold about you, including confirmation of whether we process your personal information and a copy of such information.
If you have previously agreed to share your personal information with us, you may change your preference(s) regarding the processing of such personal information at any time by emailing us at privacy@shiftplatform.tv. Withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal. If you believe that any information we are holding is incorrect or incomplete, please email us at privacy@shiftplatform.tv so that we can correct information according to your direction.
You have the right to request deletion of your personal information in certain circumstances, such as when the data is no longer necessary for the purposes for which it was collected or when you withdraw your consent.
You have the right to request that we restrict the processing of your personal information in certain circumstances, such as when you contest the accuracy of the data or when processing is unlawful.
You have the right to object to the processing of your personal information where we rely on legitimate interests as our legal basis, including for direct marketing purposes.
You also may obtain, upon request, the personal information you provided to us in a structured, commonly-used and machine-readable format.
Before providing you with a copy of your personal information or correcting, updating or deleting such information, we reserve the right to verify and authenticate your identity and the personal information to which you have requested access.

Right to Lodge a Complaint. You have the right to lodge a complaint with a supervisory authority if you believe that our processing of your personal information violates applicable data protection laws.
Changes to Our Privacy Policy
It is our policy to post any changes we make to our privacy policy on this page. If we make substantive changes to how we treat our users' personal information or to this privacy policy, we will provide at least 30 days’ advance notice before such changes become effective, including by updating the effective date of the privacy policy on this page and, where appropriate, by sending notice to the active email address associated with your account. The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Platform and this privacy policy to review any changes.
